TERMS and CONDITIONS
By enrolling or otherwise participating in any classes or events sponsored by Off Leash K9 Training Lafayette you are agreeing as follows:
You acknowledge that you understand that attendance at a private dog training class, event, and/or function is not without risk to yourself, to anyone who may attend with you and to your dog(s), since there may be situations and dog(s) to which you will be exposed that may be difficult to control and may be the cause of injury to persons or dogs, even when handled with the greatest amount of care and precaution.
You acknowledge that you assume all risks and full responsibility for yourself, your dog(s), and for anyone attending with you. You further agree to release and hold harmless Off Leash K9 Training Lafayette, Michael Kaminsky, their agents, volunteers, employees, the training facility and its property owners and management for any illness, injury, or loss that you incur to yourself, to your dog(s), and to anyone attending with you. You, as the owner of the dog(s), hereby agree to secure a proper collar and leash as directed by Off Leash K9 Training Lafayette, and to wear proper clothing and shoes to permit effective training of your dog. You agree to provide proof of vaccinations if requested and understand your dog may not be admitted to class and/or a private session will not occur without such proof. You agree and pledge to abide by the statements, terms and conditions in this waiver and will ensure the same of your companions.
You understand that the degree to which a dog is successfully trained is a function of the interest, commitment, and cooperation of you, the owner/handler. You acknowledge and agree that there is no guarantee of what my dog will achieve in training based on the instruction given, but that you as the owner/handler of your dog(s) are responsible for teaching and training your dog(s).
VETERINARIAN SERVICES; HEALTH OF K-9; RIGHT TO REFUSE TRAINING DUE TO HEALTH
Owner assumes responsibility for arranging any necessary veterinary care. In the unlikely, but possible, need for K-9 to be provided emergency care for the treatment of an injury, illness or condition for which there is a risk of permanent injury or death (an “Emergency”) Owner authorizes Trainer to make initial decisions with respect to seeking emergency veterinary services until such time as Owner can assume such decision making. Upon occurrence of an Emergency, Trainer will contact Owner as soon as practicably possible. Owner agrees that all veterinarian and medical expenses shall be paid by Owner, including, but not limited to any expenses incurred in an Emergency made because of Trainer’s decision to seek care.
Owner agrees to provide Trainer with all heath records for K-9 requested by Trainer. Owner agrees to have K-9 vaccinated and wormed as necessary. Owner shall present all proof of such vaccinations and care as Trainer may reasonably require prior to the Commencement Date of the Dog Training Services and during the course of Dog Training Services, if required. Trainer reserves the right to refuse to train K-9 in the event K-9 does not appear to be in good health, is deemed dangerous or is unable to undergo Dog Training Services for any reason as determined in Trainer’s reasonable sole discretion.
STANDARD OF CARE; RISK OF LOSS
Trainer is obligated to meet the standard of care of a reasonable prudent dog owner. In no event shall Trainer be held to any higher standard or care. Trainer’s liability with respect to the death, injury or illness of K-9 shall not exceed $500.00 per K-9.
ASSUMPTION OF RISK; INDEMNIFICATION; RIGHT TO REFUSE TRAINING DUE TO DANGEROUS K-9 BEHAVIOR
Owner acknowledges there are inherent risks associated with participation in training, both with respect to K-9 and to Owner. Owner acknowledges an exhaustive list of such risks to Owner and K-9 cannot practicably be enumerated in this Agreement. Owner expressly assumes all risks associated with participating in the Dog Training Services contemplated in this Agreement as to Owner and K-9. Owner agrees to hold Trainer and Off Leash, together with each of their respective principals, agents, affiliates, partners, successors and assigns harmless from any and all claims arising from damage or injury, whether to person or property, caused by K-9. Owner acknowledges that Trainer is an independent contractor of Off Leash and is not an employee, agent or representative of Off Leash. Trainer acknowledges and represents to Owner that Trainer is an independent contractor of Off Leash and is in full compliance with the terms and conditions of his or her independent contractor agreement, including Off Leash training standards.
Owner covenants and agrees that any and all hazardous behaviors or dangerous propensities of K-9 have been fully disclosed to Trainer. Trainer reserves the right in his or her absolute sole discretion to refuse to train or halt training if Trainer determines that K-9 is dangerous, untrainable, unhealthy, handicapped or otherwise unfit for training. Upon notification, which may be written or oral, Trainer shall return any portion of the Fee unearned to Owner within thirty (30) days of such notice and this Agreement shall be deemed to be automatically terminated.
REFUND / GUARANTEE POLICY
Lessons: We offer a money back guarantee that if you are not completely satisfied after your 1st lesson, we will completely refund your money for the program you paid for minus a $75 processing fee. You must request your money back guarantee no later than the end of the 1st lesson. We will provide a refund following the first lesson provided you return the e-collar (complete with case and accessories) and training leash in undamaged and working condition. Once the student has enrolled in a program and the 1st lesson with the primary trainer has been completed, there shall be no refunds of tuition or enrollment fees. NO EXCEPTIONS WILL BE MADE. Refunds can take up to 14 business days and will be mailed to you via USPS or via the payment method used at the time of registration.
Board and Train Program: We will provide a refund up to 30 days prior to the start of your Board and Train Program. A $175 processing fee will be applied and deducted from your initial down payment. NO REFUNDS are issued if you book or cancel less than 30 days prior to the start of the Board and Train Program. Refunds can take up to 14 business days and will be mailed to you via USPS or via the payment method used at the time of registration. NO REFUNDS once the program is started, however we offer a lifetime warranty on the Board and Train Program which consists of lifetime support and refresher classes as needed.
Puppy Consult: NO REFUNDS for this program once booked
RESCHEDULING / POSTPONEMENT POLICY
Lessons: You must provide at least 48 hours notice before the start time of your lesson should you need to reschedule. You can reschedule via the lessons calendar (https://olk9.as.me/), email (email@example.com) or call (337-347-5885). After two occurrences (reschedules), should you need to cancel, one session will be deducted from your total remaining sessions. Any rescheduling with less than 48 hours notice prior to your lesson will result in one session being deducted from your total remaining sessions.
During training, if you choose to postpone your lessons, your remaining sessions will be good for a 6-month period from the time we receive written notice sent to firstname.lastname@example.org
Board and Train Program: You must provide at least 30 days notice prior to the start of your Board and Train to reschedule which allows us to fill the training slot. NO rescheduling with less than 30 days notice. Please know that rescheduling could result in significant delays since bookings are typically scheduled more than 3 months in advance for this program. Note: Management may make exceptions to this policy in certain situations.
Please understand inclement weather sometimes may affect a scheduled lesson or turn over if the pavilion is not available, so that lesson or turn over will have to be rescheduled or moved to a different day and/or location.
